Georgia Diminished Value Claims

If you're a Georgia resident, here's you need to know about the "17C Forumla":

On November 28, 2001, the Georgia Supreme Court ruled that insurance companies are responsible for loss in market value due to damage caused in automobile accidents (diminished value) in all cases, even including ones where the driver of the damaged vehicle was at fault. The involved parties in the case agreed to use a formula referred to as the "17C Formula" in order to determine the amount covered.

Most insurance companies operating in Georgia today will try to insist on the use of the "17C Formula" in determining what they pay for diminished value claims. You are NOT required to abide by the use of this formula in determining the worth of your diminished value claim. The "17C Forumla" was developed for and applied only to the one case. It was not intended to be used in future diminished value cases, and has absolutely no bearing on any individual case outside of the original class action suit.
