Your Repair Rights

It's important that you know your rights when dealing with an insurance company. Often times insurance companies won't tell you everything you need to know about what you're entitled to in an effort to save themselves money.

You Have the Right to Choose Your Own Body Shop

Despite what an insurance company may tell you, you are not required to use the body shop they tell you to. In fact, you should almost never choose a body shop based solely on an insurance company's recommendation.

You Have the Right to All Costs and Expenses Caused by the At-Fault Party

If you weren't at fault for the accident, you are entitled to the following:

  • Compensation in full for all expenses in restoring your vehicle to its pre-damage appearance and function.
  • A rental vehicle, or payment for loss of use of your vehicle until it is fully repaired.
  • Payment for any damaged personal property inside the vehicle at the time of the accident.
  • Compensation for any out-of-pocket expenses related to the collection of your claim.
  • Payment for any medical bills incurred as a result of the accident.
  • Payment for the diminished value to the vehicle caused by the damage from the accident.

You Have the Right to the Terms of Your Insurance Policy

If you were at fault for the accident, you are entitled to the following:

  • Compensation in full for all expenses in restoring your vehicle to its pre-damage appearance and function, less your deductible.
  • If covered by your policy, the cost of a rental vehicle until your own is fully repaired.
  • If your policy has Medical Coverage (MEDPAY) or Personal Injury Protection (PIP), the cost of some or all of your medical bills incurred as a result of the accident.
  • If you live in Georgia, payment for the diminished value to the vehicle caused by the damage from the accident.
